Joking aside, the Courts use a common law "Reasonable Man" clause, at least in matters of potential negligence. Basically, was what someone did to help out the same as any other reasonable, rationale member of the public could be expected to do?

For example, with Gazz's situation - given that the engine was smoking, the car was on it's side, it would be reasonable for a layperson to want to get the person out of the car. Even if you damaged her neck, or caused further injury (dragging her over broken glass, say), it'd be a reasonable course of action.

The situation changes somewhat when you have a professional level of knowledge or training - a doctor attending the scene, for example, is held to a "reasonable professional under the circumstances" standard. So for example a doctor may be less likely to risk moving someone with a potential spinal injury, but if he can justify why he takes the decision to move her, under the special circumstances of an emergency, the "reasonable professional" clause means that again, it's very hard for someone to turn around and sue.


Also, forgot to say: props to you and your mates. Plenty of folk out there wouldn't have stopped and wouldn't have had the forethought to get the whole situation under control - emergency services, getting the occupants out, guiding traffic etc. You can be pretty proud of yourselves.

(all this time shippy was calling services, luckily the hospital is like 4 miles away from accident) . now our attention turns to how we are on a blind tight corner, we gunna get reared by a car in a minute, so with the help of this women and paul started trafficking cars around the crash that come (only 1 side blocked) then the all 3 services came after what seemed a long time but was only 5/10 mins (with the thanks to shippy, i totaly forgot about calling police :S)

but the fail of the night boys, after talking with the women before services came she said :

1. she was drunk.... FAIL
2. she was with a man she shouldnt of been with that night ... FAIL
3. she topped her fucking car !!!!!...... FAIL

multi fail.

it felt amazing to help and was proper glad as it could of been well worst.


then after we was talking to this massive MILF !!!! and her daughter was fit!!! and the Carvery was amazing, had loads of turkey and was only £3.50 !!!!!! score!!

Remindes me of one night when me and my dad were coming home from work, it was midnight (12:01, night shift) and raining. We where the only car on the highway and as we approach the notorious capilano bridge (worst highway corner on one side and worst on ramp on the other cause of a bridge), bad accident with a loging truck and cars.

we see headlights stopped in the middle of a highway. I was like wut? As we came closer a overturned car was in the headlights, so my dad stops the car in the middle of the highway, jump the barrier and phone 911. the driver of the other car opens the door and 2 bleeding legs fall out, then a person gets out. some deep cuts but not too bad. after 10 min 10 firetrucks, ambulances, police cars show up.
