Didn't they release it to the BF2 community, IIRC it was a vanilla map. Not sure on that though.

I don't know if the map is public or not, and I don't care. I've seen many different units run it on their training servers so I assume it's been publicly released. And if it isn't it's absolutely none of your business how we got it.

Copyrighting doesn't cost anything, as you don't have to actively do anything to gain the protection, as opposed to patenting, where you do.
